Terms of service

These terms govern your use of the MechManagersoftware and website (the “Service”), provided by Simplysim Solutions Ltd(“we”, “us”), trading as MechManager. By creating an account or using the Service you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
1. Who we are
MechManager is operated by Simplysim Solutions Ltd, a company registered in England & Wales under company number 16302568, registered office 4 Gallowsfield Walk, Market Drayton, England, TF9 3FP. You can contact us at hello@simplysim.co.uk.
2. Your account
- You must provide accurate registration details and keep your login credentials secure.
- You are responsible for all activity under your account and for your staff members' use of the Service.
- You must be at least 18 and able to enter into a contract.
3. Free trial, plans and billing
- The Service is offered on subscription plans, usually starting with a free trial. At the end of the trial, continued use requires a paid plan.
- Fees, billing frequency and any set-up fee are shown at sign-up or in your account. Payments are handled by our payment provider, Stripe; by subscribing you also agree to Stripe’s terms.
- Subscriptions renew automatically each period until cancelled. You can cancel at any time, effective at the end of the current billing period; fees already paid are non-refundable except where required by law.
- We may change plan pricing on reasonable notice, which will take effect from your next renewal.
4. Card payments taken through the Service
Where you enable it, the Service lets you take card payments from your own customers via Stripe. Those payments are processed by Stripe under your own Stripe account and Stripe’s agreement with you. We are not a party to, and are not responsible for, payments between you and your customers.
5. Acceptable use
You agree not to:
- Break the law, infringe others' rights, or use the Service to store or send unlawful or harmful content.
- Upload malware, attempt to gain unauthorised access, or disrupt or overload the Service.
- Resell, sublicense or copy the Service, or reverse-engineer it except as permitted by law.
- Send marketing that breaches PECR / UK GDPR using data held in the Service.
6. Your data and content
You retain all rights in the data and content you put into the Service (“Your Data”), including your customer and vehicle records. You grant us a licence to host and process Your Data solely to provide and support the Service. Where we process personal data on your behalf we do so as your processor under our Privacy policy, and you are responsible for having a lawful basis to collect and use that data.
7. Third-party services
The Service integrates with third parties such as the DVSA MOT History service and Stripe. Their data may be subject to their own terms, and we are not responsible for the accuracy or availability of third-party data (for example, vehicle lookup results).
8. Availability
We work hard to keep the Service available but do not guarantee it will be uninterrupted or error-free. We may carry out maintenance, and may add, change or remove features. We are not liable for downtime caused by events outside our reasonable control.
9. Warranties and liability
The Service is provided “as is”. To the fullest extent permitted by law we exclude all implied warranties. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything that cannot be limited by law.
Subject to that, we are not liable for loss of profits, revenue, data or goodwill, or for indirect or consequential loss; and our total liability arising out of or in connection with the Service in any 12-month period is limited to the fees you paid us in that period.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these terms, fail to pay, or where necessary to protect the Service or others. On termination your right to use the Service ends; you can request an export of Your Data for a reasonable period before it is deleted.
11. Changes to these terms
We may update these terms from time to time. We’ll update the “last updated” date and, for material changes, give reasonable notice. Continued use after changes take effect means you accept them.
12. Governing law
These terms and any dispute relating to them are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
